We handle all matters related to "Individual" Chapter 7, Chapter 13, and Chapter 11 bankruptcy proceedings, preparing and filing all the necessary documents and acting as your advocate with creditors, the bankruptcy trustee and the court.

When you hire us to help you with a individual bankruptcy filing, our first step will be to determine which bankruptcy Chapter is best suited for your case.  If you have a primary residence or investment property you wish to retain, we will analyze whether you are eligible for a Chapter 13 or 11 filing.   

If you are a consumer without mortgage concerns, we will determine whether you qualify to discharge your debts under Chapter 7. Under the recent revisions to the bankruptcy laws, you must qualify under a "means test," whereby you demonstrate to the bankruptcy court that you lack the means to pay your creditors back over a 3 to 5 year period.

If you qualify for protection under Chapter 7, you will be able to discharge certain debts to give you a chance to recover from your financial difficulties. We will help you understand which debts cannot be discharged in a Chapter 7 filing, so that you can decide if you want to go through that process. We will also make certain that any exempt assets, such as your principal residence, your car and retirement funds, are excluded from the bankruptcy sale.

If you fail to qualify for Chapter 7, your recourse in bankruptcy will be under Chapter 13. In a Chapter 13 proceeding, you restructure your debt, agreeing to pay your creditors in full over a 3 to 5 year period. We will help you put together a plan for reorganizing your debt and will review any proposed repayment plans to make certain they are within your means.

Some consumers will qualify for neither a Chapter 7 or 13 and are relegated to filing a Chapter 11 case.
